This website (“Website”) is owned and operated by the United Methodist Foundation of Western Pennsylvania (“Foundation”) for the sole purpose of serving the churches, agencies, and individuals of the Western Pennsylvania Annual Conference of the United Methodist Church.

We will make every effort to respond promptly to all communications requiring a response.

 

Account Information

Some forms and registrations on our Website require you to obtain a user name and password. You are solely responsible for maintaining the security and confidentiality of your account and password information, You are also solely responsible for all activities that occur on or through your password(s), and all uses of your account, whether or not expressly authorized by you. You agree to notify us immediately about any unauthorized use of accounts or any breach of security. By creating an account, you are also representing and warranting to us that you are of legal age and capable of forming a legally binding contract. Without cause or notice to you, we reserve the right to terminate or suspend your access to some or all of this Website, effectively immediately, if you engage in activities that we conclude, in our sole discretion, breach these Terms and Conditions, or are or may be otherwise detrimental to us. You may also terminate your account at any time by providing written notice of the same to us via email to info@umfoundation.org.  All provisions of these Terms and Conditions that by their nature should survive termination shall survive termination, including without limitation, disclaimers of warranties, limitation of liabilities, indemnity, arbitration and jurisdiction.

 

Proprietary Information

All passwords, information, names, trademarks, service marks, patents, logos, designs, slogans, photographs, videos, materials and other content ("Information") provided on our Website is confidential and proprietary to the Foundation.  Information shall be treated at all times as strictly confidential and shall not be copied or duplicated, in whole or in part, or disseminated to anyone without the prior written consent of the Foundation. You may not modify, remove, delete, add to, publish, transmit, create derivative works from, or in any way exploit, commercially or otherwise, the Information. During your use of our Website, you are expressly prohibited from copying, modifying, translating, decompiling, reverse engineering, disassembling, or otherwise determining or attempting to determine source code from any software products or to create any derivative works based upon such products.

 

Interested Parties Lists

When you request information or services, register for an event, or submit a form, we add your name and any information you provide to us to our interested parties list. Your information will remain confidential and will only be used by the Foundation and its employees to better serve you. This may include adding you to our email communications list.

 

Data Collection

Our website does use cookies. We collect informational data on, among other things, the number of visitors to our Website and page views. This data does not include any personally identifiable information. We use this information to improve the content on our Website.

Our website may provide links to outside resources. Because the Foundation has no control over these websites and the content they contain, you acknowledge and agree that the Foundation does not endorse these resources, makes no representations regarding them, and is not responsible or liable for any content, advertising, products, or other materials on or available from such resources. You further acknowledge and agree that the Foundation shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, services, or ministries available on or through any such resource.

 

Event Refund Policy

A full refund will be granted upon request 48 hours prior to an event. After that no refund will be granted. If payment is not received prior to an event and 48 hour notification of cancellation is not received, payment in full will be required. (In practicing good stewardship the Foundation seeks to minimize losses created by unpaid out of pocket expenses.)

 

Event Cancellation

We reserve the right to cancel any event. In the event of such cancellation, registrants will be notified prior to the event and full refunds will be issued in the same manner payment was made.  If applicable, registrants will be provided the option to transfer their registration to another future event. 

 

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER THE FOUNDATION, NOR, ITS DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS, SHALL BE LIABLE TO YOU UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO OUR WEBSITE OR OUR SERVICES, FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY:

 

  • LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING);

Indemnification

We reserve the right to update and change this policy, from time to time, in our discretion.

 

Governing Law/Venue

The terms of this Agreement shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to principles of conflict of laws. You irrevocably consent to the exclusive jurisdiction and venue of the appropriate state and federal courts located in Allegheny County, Pennsylvania.

By your use of our Website, you agree that you have read, understand and agree to abide by these Terms and Conditions.  You acknowledge and agree that you intend to form a legally binding contract by utilizing or viewing our Website. A printout of these Terms and Conditions constitutes a "writing" under any applicable law or regulation and shall be admissible as such in any judicial or administrative proceeding.

If for any reason any provision of these Terms and Conditions, or a portion thereof, shall be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. If any provision of the Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from the Terms and Conditions and will not affect the validity and enforceability of any remaining provisions.
